Under federal and state wage and hour laws, non-exempt associates who work more than six hours a day are required to take a full ½ hour (30 minutes) lunch after 5 hours of work, except when the workday will be completed in 6 hours or less. For example, if John Smith came in at 8:00 AM, he needs to take a 30 minute lunch by 12:59 PM. If John takes his lunch at 1:01 PM, the company has violated the law.

A reminder for all non-exempt associates (and managers): Should you work more than six hours a day, you are required to take a full ½ hour (30 minutes) lunch after 5 hours. Failure to comply will result in disciplinary action as this is a violation of company policy.
