Information About Class Action Settlement Payments

ATTENTION: ALL NON-EXEMPT, HOURLY EMPLOYEES WHO WORKED FOR ESSEX IN CALIFORNIA FROM MAY 19, 2011, TO APRIL 30, 2017:

In 2016, a class action lawsuit was filed against Essex alleging that the Company violated California wage and hour laws.  Essex has carefully reviewed its policies and practices and strongly denies these allegations.  Although the Court has not ruled on the case, Essex has made a business decision to settle this lawsuit.

A third-party settlement administrator will be mailing settlement payments to the settlement class on March 23, 2018.  Class members include current and former non-exempt California employees of the Company who worked one or more shifts from May 19, 2011 through April 30, 2017.  If you previously received a notice of class action settlement in the mail and followed the instructions contained in the notice, you may be eligible to receive a share of the settlement payment.  An estimated amount of the individual settlement payment was provided in the notice of the class action settlement.

Essex has always maintained a policy not to retaliate against any employee who complains or becomes involved in a lawsuit.  Similarly, Essex will not take action against any employee who has chosen to participate in, declined to participate in, or objected to the settlement.
