Update on Prop 65 Signs and Lease Language - CA Communities Only

Attention: All CA On-Site Associates

California's Proposition 65

California E-Team members: Thank you for your continued efforts to achieve compliance with the new requirements of California's Proposition 65 (Prop 65). As a refresher, Prop 65 is the California law that requires property owners to provide warnings before "exposing" any person to a substance listed by the state as causing cancer or causing reproductive harm. Prop 65 was amended in 2018 to change the standard warning language for signs and leases.

New Resident Compliance

As a reminder, all NEW RESIDENTS must receive the CA Proposition 65 New Resident Letter (also available in E-Way). Update the date and provide this letter to the new resident(s) at the time of move-in. Make note in Yardi when the letter is provided. We are working with On-site to have the lease language updated, but in the meantime, please provide the attached letter to ensure that we are compliant.

Current Resident Compliance

All CURRENT RESIDENTS will receive the following email message, sent through Site Manager to all current leaseholders, from Essex Communications. This message complies with the law requiring that warnings must specifically name at least one chemical and source of exposure that are the basis for the warning. If residents have questions about this message, please email their question and contact information to legalops@essex.com so that we can respond to them directly.
